Welcome to Zoey Prompts (the "Service"), an AI prompt optimization and enhancement tool. These Terms & Conditions ("Terms") govern your access to and use of the Service, including the website, browser and editor extensions, and any related features. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Zoey Prompts provides tools to analyze, polish, and optimize prompts for use with AI models, including local (in-browser) analysis and, for eligible users, AI-powered rewriting features that use third-party AI models. We may add, change, suspend, or remove features at any time without notice.

2. Accounts

• You may use limited features without an account. Some features require you to create an account with accurate, current information.
• You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
• You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service.
• We may suspend or terminate accounts that violate these Terms.

3. Subscriptions, Billing & Refunds

• Certain features (such as AI Rewrite) require a paid Pro subscription. Payments are processed securely by Stripe; we do not store your full payment card details.
• Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time, and cancellation takes effect at the end of the current billing period.
• Except where required by law, payments are non-refundable, including for partially used billing periods.
• Prices and plan features may change; we will provide reasonable notice of price changes before they apply to you.

4. AI-Generated Content

• Outputs produced by AI features are generated by machine-learning models and may be inaccurate, incomplete, or unsuitable for your purpose. You are solely responsible for reviewing and verifying any output before relying on or using it.
• We make no guarantee that AI outputs will be original, error-free, or free of third-party rights claims.
• You are responsible for how you use outputs, including compliance with the terms of any third-party AI platform where you use them.

5. Your Content

• You retain ownership of prompts and other content you submit to the Service ("User Content").
• By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display it as needed to operate and improve the Service.
• If you share content to the Community Prompt Gallery, you additionally grant us and other users the right to view, copy, and use that content within the Service. Do not share anything you want to keep private.
• You represent that you have all rights necessary to submit your User Content and that it does not violate any law or third-party right.
• We may remove any User Content at our discretion, including content that violates these Terms.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to create prompts intended to generate illegal, harmful, or abusive content;
• Upload content that is defamatory, infringing, obscene, or violates the privacy or rights of others;
• Attempt to probe, scan, breach, or circumvent security or usage limits of the Service (including free-tier limits);
• Scrape, reverse-engineer, or use automated means to access the Service beyond its intended interfaces;
• Resell or redistribute the Service or its AI features without our written permission;
• Interfere with or disrupt the Service or its infrastructure.

7. Intellectual Property

The Service, including its design, code, branding, templates, and documentation (excluding User Content), is owned by the operator of Zoey Prompts and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. No other rights are granted.

8. Third-Party Services

The Service relies on third-party providers, including payment processing (Stripe), authentication and data storage (Supabase), hosting (Vercel), and AI model providers. Your use of those services through Zoey Prompts may also be subject to their own terms and privacy policies. We are not responsible for the acts, omissions, or availability of third-party services.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless the operator of Zoey Prompts from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 5, 9, 10, and 11) will survive.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date above and, for material changes, take reasonable steps to notify you (such as a notice in the Service). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which the operator of Zoey Prompts resides, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction, and you consent to their exclusive jurisdiction.
